RoHS Directive amended
30th June 2008: expired the term
to place on the EC market electrical and electronic
equipment containing DecaBDE
Subject: DecaBDE RoHS exemption revoked
The Court of Justice of the European Communities
in Luxemburg with the Judgement1 of
1st April 2008, concerning the actions
for annulment brought by the European Parliament
vs. the Commission of the European Communities
referring to the exemption of Decabromodiphenyl
ether (DecaBDE) from the restriction of use in
electrical and electronic equipment set by the
Directive of the European Parliament 2002/95/EC
of 27th January 2003 and better known
as RoHS, has introduced the ban of electrical
and electronic equipment containing DecaBDE within
the borders of the European Community starting
from 1st July 2008.
We are pleased to inform you that the whole
Lati S.p.A. product range, currently manufactured,
already meet the requirements of the RoHS Directive,
even in its strictest formulation, except
the following:

These materials, owing to their DecaBDE content,
fall within the field of the referenced annulment
of the Commission Decision 2005/717/EC of 13th
October 2005. As a consequence, the electrical
and electronic equipments within the applicability
of the RoHS directive made of the above mentioned
products comply with the directive only if marketed
in the European Community by 30th
June 2008. Insofar, any possible RoHS statement
formerly released before the publication of the
referenced judgment has to be considered void
and superseded by this one.
We would like to bring to your attention that
the judgment applies solely to electrical and
electronic equipment marketed in the European
Community without any prejudice for other
applications outside the purpose of RoHS or different
markets.
The following products

have been and will continue to be fully suitable
for the European electrical and electronic market.

any liabilities on behalf of Lati S.p.A. except
in a writing signed by a specifically authorised
Lati S.p.A. executive. Unless otherwise agreed
in writing, the exclusive remedy for all claims
is replacement of the product or refund of the
purchase price at Lati's option, and in no event
shall Lati S.p.A. be liable for special, consequential,
incidental, punitive or exemplary damages. No
information herein can be considered as a suggestion
to use any product in conflict with intellectual
property rights. Lati S.p.A. disclaim any liability
that may be claimed for infringement or alleged
infringement of patents. Unless specifically stated
in writing, the products mentioned herein are
not suitable for applications in the pharmaceutical,
